Terms of Service for Owloud

These Terms of Service (“Terms”) are an agreement between you and Carlos Islas (“we”, “us”, or “our”) for your use of the Owloud mobile application (the “App”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The Service
Owloud is an English-learning app. You can listen to audiobooks with synchronized (“karaoke-style”) text, tap any word to see its definition or Spanish translation, save words to a personal vocabulary, and practice with flashcards.
Each chapter also has a practice session built from what you just listened to — word matching, multiple-choice comprehension, listening exercises, typed translation, word-bank and sentence-reorder exercises — and the App records your best score for each chapter. You can also download chapters for offline listening and track your progress, statistics, and streaks.
Some content is free. Other content is unlocked using “Feathers,” a virtual, time-based item that refills over time, or through a premium subscription that removes these limits (see Section 5).
2. Eligibility
You must be at least 13 years old, or the minimum age of digital consent in your country, to use the App. If you are under the age of majority, you confirm that a parent or legal guardian agrees to these Terms on your behalf.
3. Your Account
- You may create an account using your email and password, or by using Sign in with Apple or Google Sign-In. You may also be able to use the App as a guest with limited functionality.
- You are responsible for keeping your login credentials secure and for all activity that happens under your account.
- You agree to provide accurate information and to keep it up to date.
- Notify us promptly of any unauthorized use of your account.
4. License and Acceptable Use
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial language learning.
You agree not to:
- Copy, redistribute, sell, or publicly perform the audiobooks, text, audio, or other content in the App.
- Reverse engineer, decompile, or attempt to extract the source code or content, except where the law expressly permits it.
- Use the App to break any law or to infringe anyone’s rights.
- Interfere with, overload, or disrupt the App or its backend services.
- Circumvent the Feathers system, the paywall, or any other access control.
5. Subscriptions, Free Trials, and Billing
The App offers an optional premium subscription (“Owloud Pro”) that unlocks unlimited access to all books and chapters. The available plans (for example monthly, 6-month, and yearly) and their prices are shown in the App before you confirm a purchase.
- Payment. Subscriptions are sold through the Apple App Store and billed to your Apple ID. Our subscriptions are managed through RevenueCat.
- Free trial. If a free trial is offered, your subscription begins automatically at the end of the trial unless you cancel before it ends.
- Auto-renewal. Subscriptions renew automatically at the end of each period unless you turn off auto-renewal at least 24 hours before the period ends. Your Apple ID is charged for renewal within 24 hours before the period ends.
- Managing and canceling. You can manage, cancel, or turn off auto-renewal in your device’s App Store account settings at any time. Apple, not us, controls these settings.
- Restoring purchases. You can restore an active subscription on a new device or after reinstalling, using the “Restore” option in the App.
- Refunds. Purchases are handled by Apple and are subject to Apple’s refund policy. We generally cannot issue refunds directly.
6. Virtual Items (Feathers)
Feathers are a virtual item used only inside the App to unlock content. They have no monetary value, cannot be exchanged for money or transferred, and we may adjust how Feathers work (such as their cost, cap, or refill rate) as we develop the App.
7. Your Content
The App lets you save words, create a personal vocabulary and flashcard deck, and organize words into your own lists. This content, along with your practice answers and scores, is mainly stored on your device. You are responsible for the content you create. We do not claim ownership of your saved words.
8. Intellectual Property
The App, its design, the owl mascot, logos, software, synchronized text timing, translations, curated example sentences, quizzes, practice exercises, and other original content (except your own saved content) are owned by us or our licensors and are protected by copyright and other laws. Nothing in these Terms gives you any ownership of them.
Some books and audio recordings in the App are in the public domain, including audio recordings made by volunteers at LibriVox.org. We do not claim ownership of public-domain works.
9. Third-Party Services
The App uses third-party services, including Supabase (backend and login), Cloudflare (content delivery), Apple and Google (optional sign-in), the Apple App Store and RevenueCat (subscription billing and management), PostHog (usage analytics), Sentry (crash reporting), and third-party dictionary and translation services (word definitions and translations). Your use of those features may also be subject to the third party’s terms. We are not responsible for third-party services.
10. Disclaimers
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that definitions, translations, or learning content are complete or accurate. Owloud is a learning tool and is not a substitute for professional language instruction or certification.
11. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us in the 12 months before the claim, or USD 50 if you paid nothing.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the App in a way that could harm us, other users, or third parties. Sections that by their nature should survive termination (such as Intellectual Property, Disclaimers, and Limitation of Liability) will continue to apply.
13. Changes to the App and to These Terms
We may add, change, or remove features at any time. We may also update these Terms; when we do, we will update the “Last updated” date and, where appropriate, notify you in the App. Continued use of the App after changes means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of Mexico, without regard to its conflict-of-laws rules. Any dispute will be handled in the courts of Mexico City, Mexico, unless mandatory local consumer law gives you other rights.
